Agreement and scope
These Terms & Conditions govern your use of this website and the travel planning, consultation, and booking services provided by Blu Eyes Travel© (“Blu Eyes Travel,” “we,” “us,” or “our”). By using our services, approving a proposal, making a payment, or accepting an invoice, you acknowledge that you have read and agree to these terms.
Blu Eyes Travel acts as a travel advisor and intermediary between travelers and independent suppliers, including airlines, cruise lines, hotels, tour operators, transportation providers, and travel protection companies. Supplier terms also apply to your reservation.
Quotes, pricing, and payments
Travel quotes are based on availability and pricing at the time presented. Airfare, accommodations, taxes, fees, exchange rates, and supplier promotions may change until the required deposit or full payment is received and the supplier confirms the reservation.
You are responsible for reviewing names, dates, destinations, accommodations, inclusions, exclusions, and pricing before authorizing payment. Payments are processed through the approved electronic, card, or supplier payment method shown on your proposal or invoice. Blu Eyes Travel does not accept checks.
- Past-due invoices may be assessed a $100 late fee.
- Government taxes, fuel supplements, resort fees, and other supplier-imposed charges may change after booking when permitted by the supplier.
Cancellations, refunds, and changes
All cancellations and changes must be submitted to Blu Eyes Travel in writing. Supplier penalties are separate from Blu Eyes Travel professional fees, and many travel products are nonrefundable once booked.
- Cancellations are subject to a minimum Blu Eyes Travel fee of $200 per person, plus all supplier penalties.
- Cancellations made 75 days or less before departure may result in charges ranging from 25% to 100% of the invoice amount, depending on supplier terms.
- Traveler-requested itinerary changes may be assessed a Blu Eyes Travel fee of $100 per person, plus any supplier fare difference or change fee.
- Refund timing and eligibility are controlled by the applicable supplier. Blu Eyes Travel cannot issue a supplier refund before receiving or confirming it from that supplier.
Travel protection
Travel protection is not automatically included and is considered declined unless it is specifically listed on your invoice or policy confirmation. We strongly recommend appropriate travel protection because personal circumstances, weather, medical events, supplier disruptions, and other unexpected events may affect your journey.
Insurance coverage, exclusions, claim decisions, and benefits are determined solely by the insurance provider. Blu Eyes Travel does not guarantee that a claim will be approved.
Traveler responsibilities
Each traveler is responsible for verifying the accuracy of their legal name and personal details and for obtaining all required passports, visas, identification, health documents, parental permissions, and entry or transit authorizations. Names supplied for reservations must match the traveler’s government-issued identification.
Travelers are also responsible for reviewing current destination requirements, arriving on time, following supplier rules, and notifying Blu Eyes Travel promptly of errors or changes. Denied boarding or entry resulting from missing, expired, inaccurate, or insufficient documentation is the traveler’s responsibility.
Suppliers and events beyond our control
Independent suppliers control their schedules, services, equipment, staffing, routes, safety procedures, and refund policies. Blu Eyes Travel is not responsible for supplier acts or omissions; airline schedule changes; cruise itinerary changes; weather; natural disasters; strikes; civil unrest; public-health events; government actions; closures; delays; cancellations; or other events outside our reasonable control.
When disruption occurs, we will provide reasonable assistance within the scope of our services, but we cannot guarantee a particular replacement, refund, credit, or outcome that depends on a supplier.
Special requests and accessibility
Please tell us before booking about mobility needs, dietary requirements, medical considerations, room preferences, or other special requests. We will communicate requests to suppliers, but fulfillment is subject to supplier capability and confirmation and cannot be guaranteed unless confirmed in writing.
Website information and intellectual property
Destination descriptions, articles, images, offers, and other website content are provided for general inspiration and information. Availability, operating schedules, entry requirements, and supplier features may change. You should not rely on website content as a substitute for your confirmed travel documents or current official requirements.
The Blu Eyes Travel© name, original text, design, and other proprietary website materials may not be copied, republished, sold, or used commercially without written permission.
Limitation of responsibility
To the fullest extent permitted by law, Blu Eyes Travel is not liable for indirect, incidental, consequential, or special losses arising from supplier performance, travel disruption, or circumstances outside our reasonable control. Nothing in these terms excludes responsibility that cannot legally be excluded.
Travel inherently involves risks. By choosing to travel, you accept the ordinary risks associated with transportation, destinations, activities, and changing conditions.
Communications and privacy
You consent to receive booking-related communications electronically at the contact information you provide. Marketing messages are optional and may be discontinued using the unsubscribe method provided or by contacting us.
Our collection and use of personal information are described in our Privacy Policy, which forms part of these terms.
Applicable law and updates
Because Blu Eyes Travel is based in Texas, these terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Nothing in this section limits any non-waivable rights or protections you may have under applicable federal law or the laws of your state of residence. If any provision is found unenforceable, the remaining provisions will continue in effect.
We may revise these terms as our services, suppliers, or legal obligations change. The version posted when you use the website or engage our services will apply unless your signed agreement or supplier terms state otherwise.
